Terms of Service

By accessing or using the Visity platform ("Service") operated by EASILYDONE TECHNOLOGIES LLP ("Company", "we", "us", "our"), a limited liability partnership incorporated under the Companies Act, 1956, with its registered office at 80, The Meadows, Gokuldham, Near Eklavya School, Ahmedabad Sanathal, Ahmedabad, Gujarat, India, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

Visity provides a 24/7 AI-powered agent that operates on WhatsApp via the official Meta WhatsApp Business API. The Service enables businesses to automate customer interactions, qualify leads, capture lead data, and manage conversations through a web-based dashboard.

You must be at least 18 years of age and have the legal authority to enter into a binding contract on behalf of the business you represent to use the Service. By using the Service, you represent and warrant that you meet these requirements.

To use the Service, your WhatsApp Business number must be connected to the Meta WhatsApp Business API. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@visity.ai if you become aware of any unauthorised use of your account.

New customers are eligible for a 15-day free trial commencing on the date their WhatsApp number is successfully connected to the Service. No payment is required during the trial period. After the trial period expires, you must subscribe to a paid plan to continue using the Service. We reserve the right to modify or discontinue the free trial offer at any time without notice.

The Service is offered on an annual subscription basis. Payments are processed through PhonePe. Pricing is denominated in INR for India-based businesses and USD for all other regions, as determined by your billing address at the time of purchase.

Subscriptions renew automatically at the end of each annual term unless you cancel before the renewal date. You will receive a renewal reminder before your subscription is charged. All prices exclude applicable taxes.

All sales are final. We do not offer refunds after an annual subscription has been activated. Please refer to our Refund Policy for full details.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Send spam, unsolicited messages, or bulk promotional messages outside Meta's WhatsApp Business API policies
• Violate Meta's WhatsApp Business API terms, policies, or usage guidelines
• Attempt to reverse-engineer, copy, decompile, or resell any part of the Service
• Impersonate any person or entity or misrepresent your affiliation
• Upload or transmit content that is defamatory, obscene, or infringes any third-party intellectual property rights
• Interfere with or disrupt the integrity or performance of the Service

All rights, title, and interest in the Service, including software, design, trademarks, and content, are and remain the exclusive property of EASILYDONE TECHNOLOGIES LLP. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service solely for your internal business purposes during your active subscription. No other rights are granted.

The Service integrates with and relies on third-party providers including Meta (WhatsApp Business API), OpenAI, Groq, Google (Gemini), Railway.app, and PhonePe. Your use of the Service is also subject to the terms and privacy policies of these respective providers. We are not responsible for the availability, conduct, or content of any third-party service.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and processing of data as described in our Privacy Policy.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by applicable law, EASILYDONE TECHNOLOGIES LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our total aggregate liability to you shall not exceed the amount paid by you to us in the three months immediately preceding the event giving rise to the claim.

You agree to indemnify, defend, and hold harmless EASILYDONE TECHNOLOGIES LLP and its partners, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately. We will retain your account data for 90 days following termination, after which it will be permanently deleted, unless a longer retention period is required by applicable law.

You may terminate your account at any time by contacting us at hello@visity.ai. Termination does not entitle you to a refund of any prepaid fees.

We may update these Terms at any time. We will notify you of material changes via email to the address associated with your account. Your continued use of the Service after such notification constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
